Terms of Use

1. Purpose and acceptance

Imáginos is a software tool for capturing, longitudinally organizing, comparing over time, supporting AI-assisted analysis of, and generating reports from clinical dermatoscopy and trichoscopy images.

By signing up, checking the acceptance box, or accessing the platform, you confirm that you have read and agreed to these Terms, the Privacy Policy, and the Data Processing Agreement (DPA), which form part of them. Anyone accepting on behalf of a clinic or legal entity represents that they have authority to bind it.

2. Imáginos is not a medical device

Imáginos is NOT a diagnostic device and does not perform any medical act. It does not provide diagnosis, prescription, treatment recommendation, or clinical conduct. Any AI features are strictly auxiliary and informational.

Every clinical decision — including image interpretation, diagnosis, and treatment — is the sole responsibility of the qualified healthcare professional, under their technical and regulatory responsibility.

3. Registration and eligibility

Use requires registration with truthful, up-to-date information. You represent that you are a qualified healthcare professional, an authorized member of a professional's/clinic's team, or an administrator serving them; that you use the platform in your professional activity; and that you are over 18.

You are solely responsible for keeping your credentials confidential and for all activity under your account, and must notify Imáginos immediately of any unauthorized use. Imáginos will never ask for your password.

4. Patients are not users

The platform is intended exclusively for professionals and clinics; patients do not create accounts or access the platform.

By entering a patient's images and data, you act as the Controller of that data and represent that you have an adequate legal basis, including the patient's consent where required. You are responsible for the accuracy, quality, legality, and minimization of the data you enter.

5. Data protection (LGPD)

Data processing complies with Brazil's General Data Protection Law (LGPD, Law 13,709/2018), the Privacy Policy, and the Data Processing Agreement. For patient data, you are the Controller and Imáginos is the Processor; for your own registration and usage data, Imáginos is the Controller.

6. Anonymized images and artificial intelligence

As a condition of using the platform — especially on free and trial (beta) plans — you agree that Imáginos may anonymize clinical images and data, so that the data subject cannot be re-identified, and use them for research, scientific validation, statistics, and the training and improvement of artificial intelligence and computer vision models.

Under article 12 of the LGPD, effectively anonymized data is not personal data. Anonymization is performed by Imáginos before any such use. As Controller, you represent that you have a legal basis at source allowing this anonymization.

This purpose is enabled by default. You may request its exclusion by writing to privacidade@imaginos.com.br. Exclusion does not affect data already anonymized and incorporated into studies or models.

7. Plans, pricing, and payment

Imáginos may offer free, trial (beta), and paid plans. Prices, payment methods, renewal, refunds, and cancellation are disclosed on the platform at the time of contracting.

Price changes to active subscriptions apply to the next renewal period and are communicated at least 30 days in advance. For consumer transactions made off-premises, a 7-day right of withdrawal applies under article 49 of the Brazilian Consumer Code.

8. Availability and hardware dependence

The platform is provided "as is" and "as available." 100% availability cannot be technically guaranteed, and Imáginos has no obligation to maintain the service indefinitely. Imáginos is not liable for unavailability due to force majeure, internet, power, or third-party failures, or scheduled maintenance, for which prior notice will be given where feasible.

Image capture, processing, and display depend on the User's equipment, monitor, calibration, capture device, and settings, which are beyond Imáginos's reasonable control. Imáginos does not guarantee the absence of color, contrast, or brightness distortions from the User's environment. The professional is solely responsible for accounting for such variations when interpreting images.

9. Acceptable use

You must not: use the platform for unlawful purposes; reverse engineer or attempt to extract the source code; resell, sublicense, or make the platform available to third parties without authorization; attempt unauthorized access or bypass security controls; enter unlawful, malicious, or infringing content; or access the platform for benchmarking or to develop a competing product.

10. Intellectual property

All software, trademarks, logos, interfaces, and content of the platform belong to Imáginos or its licensors. Imáginos grants you a personal, limited, non-exclusive, non-transferable license, restricted to the contracted purpose.

Imáginos claims no ownership over the patient images and data you enter. Feedback and suggestions sent to Imáginos may be freely used at no cost.

11. Limitation of liability

To the maximum extent permitted by law and without prejudice to mandatory consumer rights, Imáginos is not liable for: any medical act, diagnosis, or clinical conduct, which are the professional's exclusive responsibility; clinical decisions based on images, reports, or AI features; inaccurate or unlawful data entered by the User; harm from misuse or negligent handling of credentials; unavailability or display errors arising from networks, third parties, hardware, or the User's settings; and indirect damages, lost profits, or presumed moral damages.

These exclusions do not apply to Imáginos's willful misconduct or gross negligence, to harm to life, physical integrity, or health, or to mandatory consumer rights. To the maximum extent permitted by law, Imáginos's aggregate liability for proven losses is limited to the amount paid by the User in the 12 months preceding the event.

12. Indemnification

You agree to hold harmless and indemnify Imáginos, its partners, and agents for losses, claims, and expenses (including reasonable fees) arising from: your breach of these Terms or the law; patient data entered without an adequate legal basis; or your infringement of third-party rights, without prejudice to consumer rights.

13. Term, suspension, and termination

You may close your account at any time through official channels. Imáginos may suspend or terminate the account for breach of these Terms, misuse, fraud, security risk, legal requirement, or discontinuation of the service, with reasonable prior notice where applicable.

Upon termination, Imáginos will provide, for a reasonable period, a means to recover your data, after which it may delete or anonymize it, subject to legal retention obligations.

14. Changes to these Terms

Imáginos may amend these Terms due to legal, regulatory, operational, or feature changes. Material changes will be communicated with reasonable notice, indicating the effective date, and may require renewed acceptance. Continued use after the effective date constitutes agreement; those who disagree may close their account before that date.

15. Governing law, venue, and contact

These Terms are governed by the laws of the Federative Republic of Brazil — including the Consumer Code (where applicable), the LGPD, and the Internet Civil Framework — including for users abroad. The courts of São Paulo/SP are elected, without prejudice to mandatory consumer venue.
